These terms and conditions relate to the Sustrans ‘My National Cycle Network’ film competition. By participating in this competition, you agree to be bound by these terms and conditions which are final in all matters relating to the competition and which take effect immediately that you submit your entry.
Our details
"We", "us" and "our" and “Sustrans” means Sustrans Limited, the promoter of this competition. Our principal place of business is at 2 Cathedral Square, College Green, Bristol BS1 5DD. Sustrans is a registered charity, charity no. 326550 (England & Wales) SCO39263 (Scotland) (Company No. 1797726).
1. Changes to these terms
We reserve the right to make changes to the competition and to these terms; however we will endeavour to keep such changes to a minimum. We recommend that you check these terms from time to time to see if they have changed. We will always state at the bottom of these terms the date on which they were last updated.
2. Mechanics for entry
The competition will run from 5 July 2010 to midnight on 30 November 2010 (“the closing date”).
2.1. All entries must be submitted by using the upload service at www.youtube.com and must comply with the YouTube terms of use. Entrants may submit more than one film. Each entry must include the information requested on the competition entry page which includes (but is not limited to) your name and e-mail address, postal address, telephone number and the link to your film on YouTube.
2.2. The competition is only open to UK residents, excluding employees and the immediate families of Sustrans, its agents, its competition sponsors or anyone else professionally connected with the promotion.
2.3. Teams may enter but please provide contact details for only one person per entry. Prizes cannot be expanded according to the number of entrants.
2.4. If entrants are under 16 years, their parent or guardian must consent to them entering the competition and fill in the entry form on their behalf.
2.5. Judging will take place between 30 November and 31 December 2010.
2.6. All entries will be pre-screened by a panel from Sustrans with the knowledge and experience to apply the judging criteria. A shortlist of six in each age category will be made. Each entrant on the shortlist will be contacted. An overall winner in each category will then be decided by the competition judges.
2.7. Our decision is final with respect to any aspect of the competition, including the determination of the shortlist and the winners and no correspondence will be entered into with other entrants.
2.8. We may require entrants to provide proof of age.
2.9. We reserve the right to cancel this competition at any stage. Should this happen, a notice will be displayed on the website.
3. Prizes
3.1. All prizes are non-transferable and no cash alternative will be offered. Arrangements for the fulfilment of each prize will be made through Sustrans.
3.2. The winners of each age category will be notified within 35 days of the closing date. Winners will then have 30 days to claim their prize. If a winner does not claim their prize by the time the 30 days are up, another winner will be chosen for that age category.
3.3. If a prizewinner decides not to accept any prize, they will notify the promoters of any such decision in writing and will, with effect from the date of such notice, forfeit any and all claim to the prize awarded but declined. No alternative prize will be awarded. We reserve the right to deal with the prize declined in such manner as we think fit.
3.4. Shortlisted entrants and prize winners by entering this competition must agree to participate in any subsequent publicity from the competition.
3.5. In the unlikely event of any of the prizes becoming unavailable, we reserve the right to substitute a prize which it may determine as equal or greater value.
3.6. We will not accept any responsibility for any failure or delay in any postal or courier system or the winners’ failure to accept delivery of his/her prize.
3.7. We will not be responsible for misuse of any prize, or claims, liability, loss or damage arising out of or in connection with this scheme.
3.8. The winner’s details will be published on the competition website.
The Prizes
Under 11s Category - A tour of Aardman Animations Studios
The prize will consist of a short tour of the Aardman Animation studios in Bristol, for a maximum of 4 people. The date of the tour will be determined by Aardman to fit in with their filming schedules but it will take place no later than 1 December 2011. Children under 16 must be accompanied by a responsible adult.
One night’s accommodation for a family of four sharing a family room will also be provided at the YHA youth hostel in Bristol, subject to availability. Should a room be unavailable at the YHA then alternative accommodation will be provided at the discretion of Sustrans.
Age 11-17 Category - 4 x VIP Tickets to the Relentless NASS 2011 Festival
The prize consists of 4 x VIP tickets to the 2011 Festival, which will allow access to the VIP camping area.
Persons under the age of 15 must be accompanied by an adult of 18 or over.
Tickets are subject to the Festival's full terms and conditions, which can be viewed on the NASS website.
Adults Category – 4 night break at Forest Holidays Cabin
The prize is a 4 night midweek break in a Silver Birch Cabin for up to 4 people at any Forest Holidays location.
The prize must be taken between 01 October 2010 and 30th April 2011, excluding school and Bank Holidays and is subject to availability.
The prize consists of a cabin break only and excludes extras/activities.
4. Licence for material submitted by you or footage filmed of you
By entering the competition, you hereby:
4.1 Permit us the right to edit or change entries in any way we deem appropriate at our sole discretion, including the insertion of Sustrans and ‘My National Cycle Network’ end slides to each shortlisted entry.
4.2 Grant to us a non-exclusive worldwide, sub-licensable licence to use, or allow third parties to use, any material you have provided to us in connection with the competition including photos, artwork, written text, videos and images ("Material") in any manner we choose on any media (existing now or in the future) without restriction for the full term of any rights that may exist in your Material (without payment to you or any third party). You still own your material and may use it as you wish but we have the right to use it for example by showing your Material to the general public to publish/stream it on our websites or to provide it to third parties to do similar.
Terminating the licence in your Material
If you want us to stop using your material please tell us. Submit the details of your material along with your instruction to remove this material using our email contact address. We will then stop using your material in our publicity activities as far as reasonably practicable. However we are not obliged to stop your material where it is already being used or where we have already incorporated it into compilation packages or other publicity or where we have sublicensed your material to a third party.
Your promises
It is very important that the material you provide as part of a competition is your own work. Material that you did not create yourself, or that include images of people or information about people without their permission can result in serious liability to us and to you.
Accordingly, you promise that:
i. You are the sole creator, author and owner of the Material you post or upload, or if you are not the exclusive owner you have received written consent from the owner to upload or post the Material and to grant us the rights to use the Material as set out above.
ii. Our use of your Material will not infringe any intellectual property or other rights of any third party (for example trade marks, copyright, privacy rights). This means that, if your Material contain any underlying copyrights such as music, lyrics, film footage, artwork or other copyright material owned by any other person, you confirm that you have obtained all necessary consents in writing (including from other people appearing in your Material) necessary for us to use your material as set out above.
iii. The Material does not contain anything that is defamatory, offensive or illegal.
iv. Your Material is free from any right or claim by anyone under any recording contract, publishing contract, or any union, guild or collecting society such as the Performing Right Society and you agree that you will inform us immediately if this status changes.
v. You have the right to give Sustrans permission to use the Material and you have the consent of anyone who is identifiable in the Material, or the consent of their parent/guardian if they are under 16 years.
We reserve the right to remove or withdraw entries at any time that do not comply with the above or are deemed unsuitable in any way.
Liabilities
5.1. We can accept no responsibility for entries lost, delayed, misdirected, damaged or undelivered. Incomplete and/or illegible entries will be disqualified. We shall not be responsible for technical errors in telecommunications networks, Internet access or otherwise preventing entry to any competition.
5.2. We will not be liable to you for any loss or damage arising out of or in connection with the Competition in respect of losses:
- that are related to loss of opportunity, loss of goodwill, loss of business or injury to reputation
- that are suffered by third parties
- that are caused by loss of data, or computer virus
- in respect of infringement of rights arising as a result of a third party linking to our online services and causing our content to be viewed within the pages of any other website
- that are due to your fault, for example if you have provided incorrect information to us or you fail to comply with our instructions in relation to the Competition and/or Prize
- that are not caused by our breach
- If you have a claim against another provider of services in connection with the Competition and/or Prizes you will pursue that claim independently and without recourse to us.
- We do not in any way seek to limit or exclude our liability to you for death or personal injury caused by our proven negligence.
6. Data Protection
Any personal information, including without limitation, your name, address (including postcode), telephone number and/or email address will be used (i) in connection with the Competition, (ii) as set out in these terms and conditions. Your Personal Data will not be disclosed to any third party, except to publicise the prizewinners and for the purpose of fulfilling the prize where applicable.
7. Jurisdiction
By entering the competition, entrants agree to be bound by these terms and conditions.
These terms and conditions shall be governed by and construed in accordance with the laws of England and the English courts shall have exclusive jurisdiction in relation to any disputes arising therefrom.
